1. Agreement to Terms

By accessing or using the services provided by DustinJetty LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not use our services. These Terms apply to all clients, visitors, and users of our services.

2. Services Provided

DustinJetty LLC provides digital marketing and technology services including but not limited to:

• Google Ads campaign management (Search, Display, Shopping, YouTube)
• Facebook and Instagram Ads management via Meta Ads Manager
• TikTok Ads campaign management and creative strategy
• Mobile application design and development (iOS and Android)
• Website design, development, and conversion rate optimization
• Digital monetization strategy and implementation

The scope of services for each client is defined in a separate Service Agreement or Statement of Work executed between the parties.

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information required to perform the services
• Grant necessary access to ad accounts, analytics platforms, and relevant tools
• Comply with all applicable advertising platform policies (Google, Meta, TikTok)
• Ensure your business, products, and services comply with applicable laws
• Review and approve campaign materials in a timely manner
• Pay all fees as outlined in your Service Agreement

4. Fees and Payment

Service fees are outlined in the applicable Service Agreement. Invoices are due upon receipt unless otherwise stated. DustinJetty LLC reserves the right to suspend services for accounts with outstanding balances exceeding 15 days past due. Ad spend budgets paid to third-party platforms (Google, Meta, TikTok) are separate from our management fees and are the sole responsibility of the client.

5. Intellectual Property

Upon full payment of all fees, clients receive ownership of all custom deliverables created specifically for them, including ad creatives, landing pages, and application code. DustinJetty LLC retains ownership of its proprietary methodologies, templates, frameworks, and tools developed prior to or independently of any client engagement. We reserve the right to reference completed work in our portfolio unless a non-disclosure agreement is in place.

6. Performance Disclaimer

DustinJetty LLC makes no guarantee of specific advertising results, revenue outcomes, or return on ad spend. Digital advertising performance is subject to market conditions, platform algorithm changes, competition, and factors outside our control. We commit to applying best practices, transparent reporting, and continuous optimization, but past performance does not guarantee future results.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared in the course of the engagement, including but not limited to business strategies, financial data, customer information, and proprietary processes. This obligation survives termination of the service relationship.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DustinJetty LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from or related to the use of our services, even if advised of the possibility of such damages. Our total liability shall not exceed the total fees paid by the client in the three months preceding the claim.

9. Termination

Either party may terminate the service relationship with 30 days written notice unless otherwise specified in the Service Agreement. Upon termination, the client shall pay all outstanding fees for work completed up to the termination date. DustinJetty LLC will provide reasonable transition assistance, including transfer of account access, within 10 business days of termination.

10. Third-Party Platforms

Our services involve operating on third-party platforms including Google, Meta, and TikTok. DustinJetty LLC is not responsible for changes to platform policies, algorithm updates, account suspensions imposed by these platforms, or any data practices of these third parties. Clients are encouraged to review the terms of service and privacy policies of all platforms used.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Bernardino County, California.

12. Changes to Terms

DustinJetty LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.
